Ansa Assuncao represents insurers and reinsurers in complex insurance coverage arbitrations and litigation, bad faith claims and other insurance-related disputes. Our attorneys have extensive trial and appellate experience litigating these claims in state and federal courts across the country. Our understanding of the insurance industry also allows us to advise and counsel clients in other industries with respect to insurance issues, including those involving commercial and professional liability policies.

Some recent engagements include the following:

  • Represented a leading insurance company in litigation against a policyholder’s contractual and extra-contractual bad faith claims which sought more than $8 million in compensatory and punitive damages in the United States District Court for the Northern District of Ohio. The jury found for our client and delivered a complete defense verdict.
  • Defended a leading equipment breakdown insurer/reinsurer in the United States District Court, Western District of Missouri against a policyholder’s contractual claims seeking coverage for extensive business interruption losses at a commercial printing facility.
  • Represented leading insurer in policy holder’s contractual and extra contractual claims seeking more than $15 million in property losses, extra expense and business interruption claims arising from an electrical bus duct fire in a New York City high rise. Case dismissed on motion.

Our experience extends to representing both insurers and insureds against claims seeking damages in excess of applicable policy limits, including:

  • Alleged breach of the insurer’s contractual duty to defend and indemnify;
  • Failure to settle a claim;
  • Alleged use of unfair or improper claims practices; and
  • Failure to distribute funds in a timely manner.

Ansa Assuncao also provides coverage analysis and litigates declaratory judgment actions for corporate clients on a wide array of insurance-related disputes, including cases involving long-tail claims, additional insureds, self-insured retentions (SIRs), large deductibles, fronting policies, claims made policies, insolvent insurers, Lloyd’s syndicates, and the investigation, archaeology and reconstruction of lost or destroyed insurance policies.
